1. Scope
These terms apply to quotations, orders and sales of used vehicles and machinery by Zhengzhou Pushu Machinery Equipment Co., Ltd. ("we", "us") through psautomart.com or by direct correspondence.
2. Listings and availability
All vehicles are used. Listings are provided in good faith based on information available at the time of publication, but inventory changes daily. A vehicle is only reserved once we confirm it in writing. Specifications, mileage and photographs are indicative and do not constitute a warranty unless expressly stated.
3. Quotations and pricing
Quotations are valid for 7 days unless otherwise stated and are subject to currency movement, freight rates and availability at the time of order confirmation. Prices are quoted in USD unless otherwise agreed; applicable export taxes or port charges are specified separately.
4. Payment terms
Unless otherwise agreed in writing, we require a deposit to confirm an order and the balance before shipment. Payment is made by bank transfer to the account stated on our invoice. All bank charges outside our bank are for the buyer's account.
5. Inspection and shipment
Vehicles are prepared and, where agreed, inspected and documented before loading. Risk in the goods passes to the buyer in accordance with the agreed Incoterm. Shipping schedules are estimates provided by carriers and may be affected by factors beyond our control.
6. Warranty
Used vehicles are sold in their condition at the time of sale, on an "as is" basis, unless a specific written warranty has been agreed. We are happy to arrange third-party inspection before shipment at the buyer's request.
7. Limitation of liability
Our liability in respect of any order is limited to the invoice value of the goods concerned. We are not liable for indirect or consequential losses, including loss of profit.
8. Governing law
These terms are governed by the laws of the People's Republic of China. Disputes that cannot be resolved amicably shall be submitted to the competent courts in Zhengzhou, China.
